SERNAC issues official letter to investigate violations on 600‑809 number ranges

On 25 May 2026, Chile’s National Consumer Service SERNAC dispatched an official communication to the Undersecretariat of Telecommunications SUBTEL, initiating an inter‑agency joint supervision initiative. The inspection focuses on irregular practices including mixing and misapplication of dedicated 600 and 809 number ranges within A2P services. This case illustrates Chile’s coordinated‑enforcement mechanism between telecom regulators and consumer‑protection authorities.

SERNAC’s investigation uncovered two prominent issues. First, multiple commercial entities failed to follow SUBTEL specifications for number‑range segregation, dispatching marketing traffic via the 600 notification range. Second, certain mobile operators enable default blocking rules for the 809 range, which causes lawful 809‑originated marketing communications to be inadvertently filtered. This disrupts ported‑in end‑users’ reception of legitimate enterprise messages and raises concerns around number portability, fair competition and personal‑data protection.

In its official letter, SERNAC requested SUBTEL to inform whether related probes had commenced, legal‑impact assessments completed and sanctions imposed against implicated entities. Upon receiving SUBTEL’s response dossier, SERNAC will evaluate opening individual or collective consumer‑protection proceedings. Verified infringements expose A2P service providers and carriers to dual penalties: administrative sanctions issued by SUBTEL under telecom law, combined with fines pursuant to the Consumer‑Protection Act.

The supervision scope covers all A2P aggregators, wholesale channel providers and mobile operators. Enterprises are mandated to strictly separate traffic pipelines for 600 notification‑oriented use‑cases and 809 marketing‑oriented use‑cases. The 600/809 regulatory regime does not ban commercial outbound communications; its core objective is traceable message origination, enabling end‑users to distinguish transactional alerts from marketing outreach.
