Chile Launches the “No Molestar” Do‑Not‑Disturb Consumer Platform

Chile’s Ministry of Economy and SERNAC (National Consumer Service) launched the updated “No Molestar” anti‑advertising‑harassment platform in May 2019. It centrally processes consumer opt‑out requests against marketing SMS, voice calls and push notifications, imposing mandatory response timelines and sanctions for commercial A2P communications. It constitutes Chile’s key operational system for countering unwanted marketing traffic.

Core mandatory rules: once a consumer submits an opt‑out request, companies must halt advertising SMS, voice calls, emails and WhatsApp messages within 24 working hours. Users may block per‑channel and revoke opt‑outs at any time. The platform pushes block‑requests to enterprise portals, and companies must return acknowledgement receipts confirming execution.

Non‑compliant entities face SERNAC inspections and court proceedings. Fines can reach up to 300 UTM (approx. 14 million Chilean pesos) per affected consumer. The platform does not relieve businesses from the statutory duty to provide their own opt‑out mechanisms under the Consumer Protection Act. Early‑stage complaints were heavily concentrated in telecom, finance, insurance and retail; operators including Claro, Movistar and Entel received the highest volume of opt‑out submissions.

The system interoperates with SUBTEL’s 600/809 number‑range regime. Every A2P aggregator and service‑provider must integrate with the “No Molestar” blacklist to automatically block marketing traffic to listed numbers. Transactional non‑advertising notifications such as debt‑collection alerts are not subject to these block rules.
