On 25 January 2024, witnessed by Mexico’s Federal Consumer Protection Agency PROFECO, multiple major mobile telecommunications operators signed the Agreement on Preventive Actions Against Spam in Mobile Communications to jointly tackle unwanted messages. The agreement sets control rules focusing on A2P application SMS and aims to build a safer mobile communications environment.
Signatory companies include Altan Redes, Alestra Servicios Móviles, AT&T, Izzi Móvil, Telcel and Telefónica de México (Movistar). Under the agreement, spam is defined as unsolicited electronic messages received by end users, including promotional advertisements, debt collection notices, fraudulent messages and pornographic SMS. All operators commit to establishing network rejection policies and implementing blocking measures for high-risk A2P SMS involving fraud, advertising and pornographic content.
The agreement stipulates that operators and upstream SMS aggregators must verify the legal identity of entities sending bulk SMS. Each receiving operator shall deploy anti-spam SMS systems to enable identification and filtering at the technical level. This cooperation forms part of the regular collaborative work between PROFECO and the telecommunications sector. The authority also guides citizens to utilise the REPEP Do Not Call registry to avoid harassment from commercial marketing messages.
This is a voluntary industry agreement with direct impacts on A2P aggregators. Entities providing bulk SMS services must complete identity verification; fraudulent and non-compliant marketing messages will be blocked at operator gateways. Companies offering SMS services in Mexico must comply with relevant regulatory legislation as well as satisfy the risk control requirements laid out in this industry agreement.
