AAIP received a total of 498 user complaints. Investigations confirmed that AMX Argentina persistently sent marketing SMS and voice calls to numbers registered on the national “No Llame” Do Not Call Registry, in breach of the No Llame Act (Ley 26.951). The operator also failed to submit required documentation to AAIP as mandated by regulators, violating relevant provisions of the Personal Data Protection Act Ley 25.326. The authority imposed an administrative fine of 44.9 million Argentine pesos, equivalent to approximately 33,000 US dollars at that time.

This incident carries significant industry warning implications: even leading local mobile operators may face heavy fines without proper verification against the Do Not Call Registry and adequate compliance controls over marketing communications. Enterprises providing cross-border A2P SMS services in Argentina must strictly check the No Llame registry and secure explicit Opt‑in consent from users; failure to comply may result in administrative penalties.
