Resolução nº 783/2025 is the updated General Plan for Competition Goals (PGMC) issued by Brazil’s telecom regulator Anatel. It primarily governs the telecom wholesale interconnection market, imposes critical regulations on channel access and fair trading for domestic A2P-SMS aggregators, and serves as key legal basis for TelComp association to file complaints against market monopolistic conduct by major operators.
The resolution classifies wholesale SMS traffic under regulated telecom interconnection wholesale services. Major operators with Significant Market Power (PMS) including Vivo, Claro, TIM and Algar are mandated to follow the non-discrimination principle. They may not impose unreasonable access barriers or price discrimination against third-party SMS aggregators. Large operators must publish Anatel-homologated Wholesale Reference Offers (ORPA), covering technical conditions, contracting procedures and quality standards for SMS wholesale, and open channel resources equally to all licensed telecom service providers.
The new rules establish a wholesale supervision framework including a wholesale regulatory entity and the BDA wholesale database. All wholesale SMS subscription orders from operators must be registered and recorded. Associations of small and medium-sized telecom service providers represented by TelComp may file complaints directly with Anatel under this resolution against anti-competitive practices by leading operators, such as blocking A2P wholesale channels, raising access thresholds and discriminatory treatment of aggregators, compelling large operators to open wholesale SMS resources.
For domestic Brazilian SMS aggregators, this resolution reduces institutional costs for lodging complaints against top-tier operators. However, it does not exempt aggregators from their own compliance obligations. Aggregators still need to abide by the mandatory SMS rules laid out in Resolution No.765 covering blacklists, sending time windows, opt-out mechanisms and Sender-ID registration.
