SUNDDE Publishes Document Checklist for Promotion Approval

Venezuela’s SUNDDE (National Superintendency for the Defence of Socio‑Economic Rights) has published a 12‑item requirement checklist for commercial promotion approval on its official website. It defines core mandatory documents for enterprises seeking approval for promotions delivered via SMS and automated telephone calls, grouped into four categories: enterprise qualifications, marketing copy, campaign parameters and user authorizations. It acts as supporting operational guidance for the 2014 Administrative Resolution No.004 and the 2024 approval notice, standardizing review procedures and lowering document rejection rates.

The first category covers enterprise qualification documents, including the corporate RIF tax ID and business registration records. RIF (Registro de Información Fiscal) is Venezuela’s unique taxpayer identifier. SUNDDE validates the RIF to confirm the applicant’s legal standing and stop unqualified entities or shell companies from conducting bulk marketing. Business registration documents verify business scope, legal representative and other baseline information to ensure promotions align with the company’s registered activities.

The second category consists of complete templates for outgoing SMS marketing messages. SUNDDE conducts line‑by‑line reviews, focusing on false advertising, price distortion, exaggerated performance claims and manipulative consumer prompts. All stated discounts, prize values and campaign terms must be genuine and honourable. Anxiety‑driven persuasive phrasing such as “flash sale limited time” or “last day” is prohibited. Non‑compliant templates must be revised and resubmitted.

The third category is campaign‑parameter documentation, including campaign duration, sending frequency and estimated reach. Enterprises must state start‑end dates, daily sending windows, per‑user receiving caps and projected target‑phone‑number volumes, enabling SUNDDE to assess risks of excessive user harassment. Campaigns with overly high frequency or excessive reach will require adjusted plans or supplementary explanations.

The fourth category is a written pre‑authorization guarantee. Enterprises must give written assurance that explicit, separate, retainable opt‑in consent has been obtained for every recipient number, and that consent records are available for random SUNDDE audits. False declarations or missing consent evidence result in immediate application rejection and may trigger administrative sanctions.
