Pursuant to the National Do Not Call Registry Act (Ley N°26.951, Ley No Llame), enterprises must verify the national do-not-call database prior to dispatching marketing SMS. Marketing communications shall not be sent to registered users. The official operational platform is the website nollame.aaip.gob.ar administered by AAIP. Meanwhile, the Personal Data Protection Act (Ley N°25.326) mandates that marketing SMS require explicit Opt‑in consent from users, users must be granted unsubscribe rights, and business communication logs shall be retained for a minimum of six months for inspection and review by regulatory authorities.
Decreto 2501/2014, the implementing regulation of the Do Not Call Registry Act, stipulates that marketing SMS must include standard unsubscribe keywords such as BAJA and FIN. It also restricts valid sending hours for marketing messages to 09:00–22:00 local time. AAIP Resolution No.126/2024 further specifies comprehensive operational procedures including violation classification, complaint handling, regular database updates and authorised access interfaces for enterprises, to bolster enforcement of the above rules.
For foreign A2P service providers, Argentine regulations prohibit overseas entities from conducting SMS services directly. Operations must be carried out via local TIC-licensed service providers in Argentina following completion of ENACOM service provider registration. Non-compliance may result in administrative sanctions such as fines and service restrictions. International businesses must fully satisfy all requirements: database verification, user consent acquisition, unsubscribe mechanism, log retention and local licensed onboarding to mitigate compliance risks.
